A man was fined by the Police when he was riding without a license on a large electric scooter that also did not have a seat or self-balancing system, but its 600W motor allowed it to reach speeds over 40 km/h. The judge convicted him for driving a motor vehicle without a license, as that scooter, due to its power and speed, is not a simple Personal Mobility Vehicle (VMP), but legally a moped (and for that, a license is required).

The accused appealed arguing that he did not think a license was necessary because the store told him it was a VMP and because the regulations did not seem clear to him. However, the Provincial Court (AP) did not agree with him. According to the AP, any reasonably informed and careful person should have known that this type of scooter required a license —especially because even on the store's website they warned that, to comply with the rules, the speed had to be limited to 25 km/h, and that the device could reach 40 km/h. The AP clarifies that when someone starts using any potentially dangerous device in public roads, they have the obligation to inform themselves properly
